These Terms & Conditions (“Terms”) govern your access to and use of Dojo Kidz digital collectibles (“NFTs”), merchandise, website, and related services (collectively, the “Services”). By purchasing, holding, or interacting with Dojo Kidz NFTs or merchandise, you agree to these Terms.

1. Ownership of NFTs & Intellectual Property Rights

  • When you purchase a Dojo Kidz NFT, you own the digital token recorded on the blockchain.

  • As the NFT holder, you are granted full commercial intellectual property (IP) rights to the specific NFT artwork you own. This includes the ability to create, distribute, and profit from derivative works or commercial projects featuring your NFT.

  • These rights are exclusive to the holder of the NFT and transfer upon resale of the NFT.

  • Limitations:

    • You do not own the Dojo Kidz brand name, logos, or trademarks.

    • You may not create, market, or distribute any content, merchandise, or products that are presented as “official Dojo Kidz.”

    • Only Dojo Kidz can produce and authorize official brand content, products, or experiences.

2. Merchandise Purchases

  • All merchandise sales are subject to our [Shipping & Returns Policy].

  • Prices are displayed at checkout and may exclude shipping, customs fees, or taxes, which are the customer’s responsibility.

  • Dojo Kidz reserves the right to change prices, product availability, or shipping fees at any time.

3. Risk & Responsibility

  • Dojo Kidz NFTs are digital assets stored on the blockchain. You are solely responsible for:

    • Your digital wallet and private keys.

    • Safeguarding your NFTs from loss, theft, or transfer errors.

  • Dojo Kidz is not responsible for lost access, accidental transfers, or issues caused by third-party marketplaces or wallets.

  • The value of NFTs is speculative and not guaranteed. Dojo Kidz does not promise any financial returns.

4. Prohibited Uses

You agree not to use Dojo Kidz NFTs, artwork, or merchandise for:

  • Hate speech, racism, sexism, homophobia, or any discriminatory purpose.

  • Illegal activities or promoting violence.

  • Creating or selling counterfeit or unauthorized merchandise.

  • Misrepresenting content as officially produced or endorsed by Dojo Kidz.

5. Intellectual Property (Brand & Trademarks)

  • While holders have full IP rights over their individual NFT artwork, the Dojo Kidz brand, name, logos, and trademarks remain the exclusive property of Dojo Kidz.

  • Any use of the brand name, logos, or trademarks for commercial purposes without written permission is strictly prohibited.

6. No Guarantees & Liability

  • Dojo Kidz NFTs and merchandise are provided “as is.” We make no guarantees regarding future value, utility, or availability.

  • Dojo Kidz is not liable for:

    • Delays or issues with shipping carriers or customs.

    • Loss of NFTs due to user error, wallet issues, or blockchain instability.

    • Any indirect, incidental, or financial damages related to NFT ownership or merchandise purchases.

7. Community & Conduct

By participating in Dojo Kidz communities (Discord, social media, events), you agree to act respectfully. Dojo Kidz reserves the right to remove or ban members who violate community standards.

8. Modifications to Terms

Dojo Kidz may update these Terms at any time. Updates will be posted on our official website. Continued use of NFTs, merchandise, or Services after updates means you accept the revised Terms.

9. Governing Law

These Terms are governed by the laws of the jurisdiction where Dojo Kidz operates, without regard to conflict-of-law principles.
